📄️ 12.0 Individual Policy Provisions
Learning Objectives
📄️ 12.1 Mandatory Uniform Provisions
The Mandatory Uniform Provisions, established by the National Association of Insurance Commissioners (NAIC), are legally required to be included in all individual accident and health insurance policies. While insurers may use alternative wording, it must be at least as favorable to the insured as the standard language. Insurers are not permitted to include additional provisions that limit or alter the intent of these required provisions. There are 12 Mandatory Uniform Provisions, all of which are designed to protect the rights and interests of the insured.
📄️ 12.2 Optional Uniform Provisions
These provisions are optional and may be included at the discretion of the insurer. However, if they are used, they must comply with applicable state insurance laws. These provisions are primarily intended to protect the interests of the insurer.
📄️ 12.3 Other Standard Provisions and Clauses
The following section outlines commonly recognized standard provisions that may be included in both individual and group insurance contracts. Learners should be aware that the specific terminology and application of these provisions can vary depending on state laws and regulatory requirements.
📄️ 12.4 Policy Renewal Provisions
Each health insurance policy must clearly state the conditions and provisions governing the continuation of coverage. The policy must specify both the effective date and the termination date. Insurers may cancel or decline renewal in accordance with the applicable renewal provision, particularly if required premium payments are not maintained.
📄️ 12.5 Cost Containment in Health Care Delivery
Managed health care systems are designed to control and reduce the costs associated with delivering health care services. These plans typically incorporate a range of cost-containment strategies and services aimed at improving efficiency, managing utilization, and maintaining quality of care.
